REAL ESTATE TECHNICAL DIAGNOSIS


Under Articles L.271-4 et seq. of the Code de la construction et de l’habitation relating to the technical diagnosis file and Article 46 of the Act of 10 July 1965 relating to the certificate of privative surface area, any person offering for sale or for rental property must supply the future buyer with a real estate diagnosis file. As for those to be handed over when renting, the mandatory diagnosis are regulated by article 3-3 of the Act of 6 July 1989. The purpose of this technical record is to inform the purchaser or the lessee about certain aspects of the property that he plans to buy or lease. It is therefore essential to obtain clear and accurate diagnosis, as soon as the sale agreement is signed, or in the absence of a sale agreement, it must be established at the time of signing the sale deed. And, in the case of a public sale, the technical diagnosis file must be annexed to the requirements specification.

Choosing a diagnostician is not easy, he must be certified to perform all diagnoses by a certifying body approved by COFRAC and must have taken out professional liability insurance. If the diagnostician is not certified, the seller may be fined. Likewise, in the voluntary absence of foregoing diagnosis and in the event of incorrect information in the drafting of the advertisement that could mislead the buyer, the seller may be held liable.
